Terms of Service

1. Scope and operator
These Terms of Service ("Terms") apply to all use of our online store and to all orders placed through it. The store is operated by Aura Of Switzerland, St.Gallen, Switzerland ("we", "us", "our"). You can contact us at info@auraofswitzerland.com.
Our Refund & Returns Policy, Shipping Policy and Privacy Policy form part of these Terms. Our store is intended for consumers buying for personal use, not for commercial resale.
2. Eligibility and accounts
You must be at least 18 years old, or have the consent of your legal representative, to place an order. The information you provide must be accurate, current and complete. If you create a customer account, you are responsible for keeping your login details secure. Accounts are personal and may not be transferred.
3. Products
All products are made to order, which means each item is produced only after you place your order. We describe and depict our products as accurately as possible. Colours may look different depending on your screen. Minor variations in colour, print placement and dimensions, which are typical of on-demand production, may occur. We may change product descriptions, discontinue products or limit quantities at any time. This does not affect orders we have already confirmed.
4. Orders and contract formation
The products shown in our store are an invitation to order, not a binding offer. When you complete checkout, you submit a binding offer to purchase. You can review and correct your entries before submitting. The contract is concluded when we confirm your order by email.
We may decline an order, for example in case of suspected fraud, an obvious pricing error or unavailability. If we do, we will refund any amount already charged in full.
Once production has started, an order can no longer be changed or cancelled. Returns, exchanges and the right of withdrawal for customers in the EU/EEA and UK are governed by our Refund & Returns Policy.
5. Prices and payment
Prices are shown in Swiss francs (CHF) or in the currency displayed in the store, and are final prices. Shipping costs are shown separately before you complete your order. The price shown at the time of your order applies; prices and promotions may change at any time after that.
Payment is due when you place your order, using one of the payment methods offered at checkout. By providing payment details, you confirm that you are authorised to use that payment method.
6. Shipping, delivery and import charges
We ship to the countries available at checkout. Our products are produced and shipped by production partners located outside Switzerland. Delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs clearance or events beyond our control.
Deliveries may be subject to import VAT, customs duties and carrier clearance fees. Unless stated otherwise at checkout, these charges are not included in our prices and are payable by you to the carrier or customs authority on delivery. Details are in our Shipping Policy.
The risk of loss or damage passes to you upon delivery. If a parcel is refused, not collected, or cannot be delivered because of an incorrect address, our Refund & Returns Policy applies.
7. Warranty
The statutory warranty provisions apply. Please inspect your order when you receive it.
- Visible defects, transport damage and incorrect items must be reported to us within 30 days of delivery, with photos.
- Defects that only become apparent later must be reported as soon as you discover them.
- For a confirmed defect, we will first send a free replacement. If a replacement is not possible or also fails, you may request a refund or a price reduction.
To the extent permitted by law, normal wear and tear, damage caused by improper care, and the minor variations described in Section 3 are not considered defects.
8. Liability
We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, and under mandatory product liability law. Otherwise, to the extent permitted by law, our liability for slight negligence is excluded, and our total liability in connection with an order is limited to the amount paid for that order. To the extent permitted by law, we are not liable for indirect or consequential damage, such as lost profits.
Information in our store is provided for general information purposes only.
9. Intellectual property
All content in our store, including designs, logos, trademarks, texts, images and videos, is owned by us or our licensors and is protected by intellectual property law. You may use our store only for personal, non-commercial purposes. You may not copy, reproduce, distribute, modify or otherwise use any content without our prior written consent.
Purchasing a product does not grant you any rights to the designs on it beyond personal use of that product. Shopify's name and logo are trademarks of Shopify.
10. Reviews and feedback
If you submit reviews, comments or other content, you grant us a free, non-exclusive, worldwide and perpetual licence to use, reproduce, edit and publish it in connection with our store and our marketing. You confirm that your content does not infringe any third-party rights and is not unlawful or offensive. We may moderate or remove content at our discretion.
11. Prohibited use
You may use our store only for lawful purposes. In particular, you may not:
- violate any law or third-party rights;
- transmit false or misleading information, spam or malware;
- collect other users' personal data;
- scrape, copy or resell any part of the store;
- circumvent security measures or interfere with the store's operation.
Automated tools, including AI agents, may only access the store if they clearly identify themselves as such and respect any restrictions we set. We may suspend or close accounts that violate these Terms.
12. Third-party tools and links
Our store may contain third-party tools or links to external websites. We do not control them and are not responsible for their content, products or services. You use them at your own risk and subject to the third party's terms.
13. Relationship with Shopify
Our store is hosted on Shopify, which enables us to provide our services to you. However, all sales and purchases you make in our store are made directly with us. By using our store, you acknowledge that Shopify is not responsible for any aspect of sales between you and us, including any injury, damage or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with us.
14. Privacy
We process personal data in accordance with our Privacy Policy. Because our store runs on Shopify, certain data is also processed by Shopify and its service providers, some of which may be located outside Switzerland. More details are in our Privacy Policy and in Shopify's privacy policy.
15. Errors
Our store may occasionally contain errors in product descriptions, prices, promotions, shipping costs or availability. We may correct such errors at any time. In the case of obvious errors, we may cancel affected orders, even after they have been placed, and will refund any payment in full.
16. Changes to these Terms
We may update these Terms at any time. The version published at the time of your order applies to that order.
17. Final provisions
If any provision of these Terms is invalid, the remaining provisions remain in effect. If we do not enforce a right, that does not mean we waive it. You may not assign your rights under these Terms without our consent.
These Terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, the mandatory consumer protection provisions of your country of residence remain unaffected. Mandatory rules on jurisdiction for consumers apply. In all other cases, the courts at our place of business have exclusive jurisdiction.
